1. Overview

At Callloom, we are committed to respecting intellectual property rights and complying with the Digital Millennium Copyright Act (DMCA). This Copyright Policy outlines the procedures by which copyright owners may report suspected infringement of their protected works and the steps Callloom will take in response to valid and properly submitted notices. This policy applies to all content hosted, displayed, or made available through our platform and website (www.callloom.com), including any user-generated or third-party content accessible through the services we provide.

If you believe that your copyrighted material has been used in a way that constitutes infringement and is accessible via the Callloom platform, you may submit a formal notification as described below. We will review all valid claims and take appropriate action, which may include content removal, restricted access, or account termination, where applicable.

2. Submitting a Copyright Infringement Notice

To be legally effective under the DMCA (17 U.S.C. § 512(c)(3)), a written notice of claimed infringement ("DMCA Notice") must include all of the following elements:

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  • A clear identification of the copyrighted work(s) you claim have been infringed. If multiple works are covered by the notice, you may submit a representative list.
  • A detailed description of the material you believe to be infringing and information reasonably sufficient to allow us to locate the material (e.g., specific URLs, titles, upload dates).
  • Your full contact information, including your name, mailing address, telephone number, and a valid email address.
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information provided in the notice is accurate.
  • A sworn declaration under penalty of perjury that you are the copyright owner or are authorized to act on behalf of the owner.

3. Where to Send Your DMCA Notice

We strongly recommend that you submit your DMCA notice via email for the fastest processing. If you prefer to send a hard copy, please contact us by email first to obtain our physical mailing address.

4. What Happens After We Receive Your Notice

Upon receiving a properly formatted DMCA Notice, Callloom will conduct a prompt review. If we determine that the content in question may be infringing, we will take action as required under the DMCA. This may include removing or disabling access to the material or notifying the user responsible for the alleged infringement.

In appropriate circumstances, particularly in the case of repeat offences, Callloom may also terminate user accounts found to be in violation of copyright laws.

5. Counter-Notification Procedure

If your content was removed or access to it was disabled due to a DMCA Notice and you believe that the removal was a mistake or that you have the right to use the material, you may file a counter-notification. This counter-notice must meet the requirements of 17 U.S.C. § 512(g)(3) and include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, along with the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the U.S. Federal District Court for your judicial district (or if outside the U.S., the appropriate U.S. jurisdiction where Callloom is located), and that you will accept service of process from the person who submitted the original DMCA Notice.

6. Legal and Financial Consequences

Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing (or that it was removed in error) may be subject to liability for damages, including legal fees and associated costs. We reserve the right to seek such remedies to the fullest extent permitted by law.
