Call Loom is a business-to-business platform designed to help companies track, analyze, and optimize customer phone interactions through advanced call data tools. By using Call Loom, you affirm that you are authorized to act on behalf of your organization and are entering into a binding legal agreement with Call Loom.
Call Loom grants you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You agree to use the Services only for lawful purposes and in compliance with all applicable laws, regulations, and third-party agreements. You may not use the Services in a way that interferes with their normal operation or affects the use of the Services by other users.
Users are responsible for maintaining the confidentiality of their account credentials. You agree not to share your login credentials with unauthorized parties and to notify Call Loom immediately of any unauthorized access to your account. Call Loom is not liable for any loss or damage arising from unauthorized use of your account.
Your use of the Services involves the collection and processing of call data, including phone numbers, call durations, call recordings (where enabled), and associated metadata. All such data is processed in accordance with our Privacy Policy and applicable data protection laws. By using the Services, you represent that you have obtained all necessary rights, consents, and authorizations to collect, record, and process such data via Call Loom.

If you enable call recording on your Call Loom account, you acknowledge and agree that you are solely responsible for compliance with all local, state, national, and international laws relating to the recording of telephone conversations. This includes informing all participants that the call may be recorded, where required. Call Loom provides tools to facilitate compliance, but the legal responsibility rests entirely with you.
Call Loom does not monitor the contents of your call recordings and assumes no liability for their legality, accuracy, or use. You agree to indemnify Call Loom against any claims arising from your use of call recordings through the platform.
Access to Call Loom's Services may require payment of fees as outlined in your service agreement or subscription plan. All fees are billed in advance, unless otherwise specified, and are non-refundable except as required by law. You authorize Call Loom to charge your designated payment method for all applicable fees.
Failure to pay fees on time may result in suspension or termination of your access to the Services. Call Loom reserves the right to change pricing at any time, but we will notify you in advance of any changes that would affect your current billing cycle.
Call Loom owns all rights, titles, and interests in and to the platform, including its software, code, analytics tools, brand, and any content created or provided by Call Loom. Except as explicitly permitted by these Terms, you may not reproduce, modify, distribute, or create derivative works based on any part of the Services without prior written consent from Call Loom.

Call Loom disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that data will be preserved without loss.
You use the Services at your own risk. Call Loom is not liable for any damages, including indirect or consequential damages, arising from your use of or inability to use the Services.
To the maximum extent permitted by law, Call Loom and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from or relating to these Terms or your use of the Services, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.
You may terminate your use of the Services at any time by cancelling your account. Call Loom may suspend or terminate your access to the Services at our discretion, with or without notice, if you violate these Terms or pose a risk to the integrity or security of the platform.
We are continuously improving Call Loom and may add, modify, or remove features or functionalities at our discretion. When such changes materially affect your use of the service, we will make reasonable efforts to notify you in advance. Continued use of the platform after changes are published constitutes your acceptance of the modified Terms. If you do not agree to the new terms, your sole remedy is to discontinue use of the service.
Call Loom is provided “as is” and “as available.” While we strive to maintain high availability and accuracy, we make no guarantees that the platform will operate without interruptions, delays, or errors. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written advice or information obtained from Call Loom or its representatives shall create any warranty not expressly stated herein.
To the fullest extent permitted by law, Call Loom and its affiliates, officers, employees, agents, partners, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the platform. This includes, but is not limited to, loss of profits, business interruption, data loss, or other intangible losses, even if we were advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the service will not exceed the total amount you have paid to Call Loom in the past twelve months.
You agree to defend, indemnify, and hold harmless Call Loom, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your breach of these Terms, or your violation of any law or the rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the use of Call Loom shall be subject to the exclusive jurisdiction and venue of the courts located in New Castle County, Delaware.
These Terms, along with our Privacy Policy and any additional agreements or policies referenced herein, constitute the entire agreement between you and Call Loom with respect to the use of the platform. They supersede all prior or contemporaneous communications, whether oral or written, regarding the subject matter herein.
